Welcome to Praxis Golf. These Terms of Service ("Terms") govern your use of our golf practice application and related services ("Service") operated by Praxis Golf ("us", "we", or "our").
Acceptance of Terms
By accessing and using our Service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Age Requirements
Our Service is intended for users who are at least 13 years old. If you are under 13, you may only use our Service with verifiable parental consent. If you are under 18, you may only use our Service with the involvement and consent of a parent or guardian. We encourage young golfers to use our Service as a learning tool with appropriate adult supervision.
User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You are fully responsible for all activities that occur under your account.
Subscription and Payment
If our Service is offered on a subscription basis, subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law. Your subscription will automatically renew unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.
Acceptable Use
You agree not to use the Service:
- For any unlawful purpose or to solicit others to unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
- To impersonate or attempt to impersonate another user, person, or entity
- In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
Content and Data
You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.
Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.
GPS and Location Services
If the Service includes GPS or location-based features, you acknowledge that such features are provided for convenience and may not always be accurate. We do not guarantee the accuracy of GPS data or location information and shall not be liable for any issues arising from reliance on such data. Use GPS features at your own risk and always use proper judgment on the golf course.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.
Disclaimer
The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms whether express or implied, statutory or otherwise.
Limitation of Liability
In no event shall Praxis Golf, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
Export Control
You may not use, export, import, or transfer the Service except as authorized by U.S. law and the laws of the jurisdiction in which you obtained the Service. In particular, the Service may not be exported or re-exported (a) into any U.S. embargoed countries, or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Denied Persons List or Entity List. By using the Service, you represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
Mobile Application Terms
If you access our Service through a mobile application downloaded from the Apple App Store, Google Play Store, or other app marketplace, you acknowledge that these Terms are between you and Praxis Golf only, not with the app store. The app store is not responsible for the Service, its content, maintenance, support services, or warranty. You agree to comply with all applicable third-party terms of agreement when using the mobile application. The app store and its subsidiaries are third-party beneficiaries of these Terms and will have the right to enforce them.
Device Compatibility
We may update our mobile applications from time to time. While we strive to maintain compatibility, we do not guarantee that any version of our mobile application will work on all devices or operating systems. We are not liable for any loss or inability to use the Service due to device incompatibility or software updates.
Governing Law
These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
